GIST OF THE CASE-

                         The contract for the work of concreting in foundation of TG and Boiler area at STPS, Sarni extension 2x200 MW units was awarded to M/s Bhandati Builders Pvt. Ltd., New Delhi.  The arbitration on the application of contractor for claim of Rs. 27,97,450/- and Rs. 31,11,000/- and Board’s claim for Rs. 12,17,000/- was initiated by S.E.(C) C&M, Sarni to sort out the disputes arised after directive of Dist. Court, Jabalpur.  However, the decision were already announced in past by different two committees constituted by the Board.

                        The Board had filed an appeal in the High Court, Jabalpur against the order passed by District Court, Jabalpur and prayed to “acceptance of decision of these two committees earlier constituted by the Board and not by hold any further arbitration by the S.E.(C) C&M, Sarni in the matter”.  This appeal was dismissed by the High Court on 28-11-1994.  Board’s counsel Shri M.L. Jaiswal, Jabalpur had filed an application against this decision and requested to the High Court to “Rehear” the case on certain ground.  As intimated by our counsel, a notice has been served to the contractor.  Since then the application is pending in the High Court, for decision of acceptance/rejection for rehearing.
