OF THE CASE:-
Against an order dtd. 14.02.77 on Candy Filters for Satpura TPS
Units 6&7 for supply of resin, Excise Department refunded back some
ED amount got deducted in excess to Candy but they did not returned back
it to MPSEB. Therefore, a decree was obtained from JBP Court to recover
Rs. 7, 90,000/- from Candy and same was transferred to Mumbai High Court
by Jabalpur Court only on 30.04.99. However, this could not be located
in Mumbai Court as informed by our earlier counsel in the case on
12.04.2001. In view of this after vigorous persuasion revised decree was
obtained for Rs. 22, 69,622/- and application filed in Mumbai High court
on 19.01.2002 for serving the notice. PRESENT
STATUS OF CASE:- Decree
could not be served due to non availability of correct address (new) of
firm so far. Therefore, the Registrar of companies Mumbai has been
approved to find out correct address of firm in question but their reply
is awaited. |
