GIST OF THE CASE:-

            Collector Jabalpur required 432.61 acres of land at Rampur and  Badanpur area Jabalpur for MPSEB from some villagers and the amount of compensation as deter minded by land acquisition office was paid, leter on ADJ court was educed the amount of compensation vide order dtd. 06.10.67 total   Rs. 4,48,371/- amount was paid on 15.09.69 meanwhile the collector filed an appeal before the High Court against the awarded dtd. 06.10.67. Hon’ble High Court vide judgment dtd. 18.11.76 allowed the appeal and reduce the compensation amount, accordingly collector Jabalpur moved an application u/s 144 cpc for restitution and payment of interest thereon before ADJ Jabalpur but court has rejected the application after hearing vide order dtd. 06.03.03. Against the order dtd. 06.03.03 an appeal is filed before the M.P. High Court fo set aside the order dtd. 06.03.03 and order to repay the difference amount with interest to Board.
